For Sale By Owner

Selling as a For Sale By Owner, without an agent (also known as FSBO), is not terribly difficult if the market is moving fast and inventory is snapped up as soon as it becomes available for sale. However, for most FSBOs, finding buyers is typically a challenge, not to mention, finding a buyer is only the first step, and there is a lot that can go wrong between contract acceptance and closing. If you’re going to be selling your home, a purchase agreement is one of the first steps to securing the deal. A purchase agreement is simply the written agreement between the buyer and seller outlining the terms of the sale. Most purchase agreements will include details such as the sales price, closing date, and any contingencies the sale hinges on—such as the home passing inspection or appraising at a value that your lender agrees is high enough to warrant a mortgage. These can be drawn up by a skilled real estate attorney, such as the ones found at Anderson Legal Group, PC. When managing this possibly very complex process, the easiest and smartest thing you should do is hire a local real estate attorney for a fixed fee and have him or her prepare the documents, assist you or the buyer in the purchase of a title policy, and conduct the closing.

An attorney will guide you through the paperwork, ensuring that you are complying with state law every step of the way. Your real estate attorney will also work closely with the title or settlement company and the buyer’s attorney to make sure that the transaction proceeds smoothly. A local real estate attorney is likely to have worked with the title company and opposing attorney on past transactions, making it even more likely that your deal will move forward without complications.

The last place you want to be is at the closing table with a professional closer and your buyer’s attorney staring at you and expecting you to respond to a legal question that you are not prepared to answer. You need an experienced advocate on your side to be certain that your interests are always represented.

Title Company v. Real Estate Attorney

When you are ready to purchase a home, it can be the most expensive purchase that you will ever make. Don’t make a mistake and end up with a home that isn’t worth what you paid, or that has title issues or other legal problems. You can avoid those big risks when hiring a real estate attorney who will look out for your best interests.

A Title Company represents only the title insurer, whereas an Attorney represents whoever hired them, a buyer or seller. Once hired, an attorney not only oversees the entire transaction until completely, but also looks out for their client’s best interest and advocates for their client.

Title companies are not able to give legal advice to either party. Even if the Title company has an attorney running the office, the transaction is their client; you are not. While a Real Estate Attorney will be able to review documents and answer legal questions during the contract negotiation process; title companies cannot.

Title agents may not be able to effectively correct an issue in the title if one arises. Depending on the issue, a title agent will actually request the parties to hire out an attorney (at their own expense) to handle specific issues such as a suit to quiet title. Not having an attorney can delay the closing or even cause it to fall through.

At the end of the day, you need someone who is on your side. At Anderson Legal Group, PC, we strive to make your life easy by standing by you and ensuring that your closing goes as smoothly as possible.
